The new points test is part of a series of reforms to the skilled migration program announced in February 2010.&nbsp;&nbsp;It is proposed that the new points test will apply to applications made from 1 July 2011, unless the applicant is eligible for transitional arrangements.<br />
<br />
Transitional arrangements apply to people who, on 8 February 2010 held or had applied for a Temporary Skilled Graduate visa (subclass 485).&nbsp;&nbsp;Until the end of 2012, this group is able to apply for a permanent skilled visa under the points test in effect as at 8 February 2010.<br />
<br />
Student visa holders who lodge an application for points tested skilled migration visas from 1 July 2011 will be assessed under the new points test. There are still transitional arrangements which may apply to those students affected by the reforms announced on 8 February 2010.<br />
<br />
People who held an eligible Student visa on 8 February 2010 still have until the end of 2012 to apply for a Temporary Skilled Graduate visa (subclass 485) under the arrangements in place for that visa as at 8 February 2010. <br />

MOVING TO ANOTHER AREA WHILE HOLDING A SKILLED - REGIONAL SPONSORED VISA:<br />
<br />
If granted a Skilled - Regional Sponsored visa, you and any secondary applicants will have a condition (condition 8539 or 8549) placed on your visa which requires you to live and work or study in a Specified Regional area whilst you are in Australia.<br />
<br />
A Specified Regional area is a:<br />
*designated area if you were sponsored by a relative or *regional or low growth metropolitan area if you were sponsored by a state/territory. <br />
<br />

PERMANENT VISA PATHWAYS FOR SKILLED - REGIONAL SPONSORED VISA HOLDERS:<br />
<br />
The Skilled - Regional Sponsored visa is a temporary (provisional) visa. Before you can apply for a permanent visa you will need to demonstrate that after you have been granted a Regional - Sponsored visa. <br />
You must have:<br />
*lived in a Specified Regional area in Australia for at least two (2) years *worked full time for at least one (1) year.<br />
<br />
There is no restriction on the type of work that you may undertake and the only restriction is that the work is 'full-time' and undertaken in a regional or low population growth metropolitan area in Australia.<br />
<br />
The Australian Bureau of Statistics defines a 'full-time position' as one in which employment is normally for 35 hours a week. There may be some occupations, however, where full-time employment is less than 35 hours a week therefore you may be able to undertake two (2) part time positions in closely related occupations that equate to 35 hours per week. Please also note that any employment that is less than 30 hours a week will not be regarded as full-time.<br />
<br />
For Skilled - Regional Sponsored visa holders, only periods of work and residence accumulated in a Specified Regional area in Australia after you were granted the visa will be counted towards meeting these requirements. <br />
<br />
A Specified Regional area is a:<br />
*designated area if you were sponsored by a relative or *regional or low growth metropolitan area if you were sponsored by a state/territory. <br />

Please note however, that the RSMS requires that you obtain employer sponsorship in support of your application.<br />
<br />
The Skilled - Regional visa does not require relative sponsorship or state/territory nomination in support of your application.<br />

WORK EXPERIENCE REQUIREMENTS:<br />
<br />
To be granted a General Skilled Migration visa, there are a number of requirements that must be met which relate to your work experience in a skilled occupation/s. The 'recent work experience' requirement applies to all General Skilled Migration visas, while the 'specific work experience', 'Australian work experience' and 'partner skills' requirements only need to be met if you wish to claim points for that part on the General Skilled Migration points test.<br />
<br />
The following information is a summary of the various work experience requirements and provides links to more detailed information on the department's website.<br />
<br />
APPLICANTS NEEDING TO MEET THE RECENT WORK EXPERIENCE REQUIREMENT:<br />
<br />
If you are applying for a Skilled - Independent (subclass 175), Skilled - Sponsored (subclass 176) or Skilled - Regional Sponsored (subclass 475) visa, you must meet the recent work experience requirement unless in the six (6) months immediately before applying for a General Skilled Migration visa, you have met the Australian study requirement. <br />
<br />
If you are nominating a trade occupation, you will not be able to apply for a Skilled - Independent (subclass 175), Skilled - Sponsored (subclass 176) or Skilled - Regional Sponsored (subclass 475) visa based on meeting the Australian study requirement. You can only seek to satisfy the recent work experience requirement.<br />

RECENT WORK EXPERIENCE REQUIREMENT:<br />
<br />
To meet the recent work experience requirement (no points awarded), you must demonstrate that you have been employed:<br />
*in an occupation on the Skilled Occupation List (SOL) *for at least 20 hours a week *in a paid position *for at least 12 of the 24 months immediately before lodging your visa application.<br />
<br />
Note: If you are nominating a specified trade occupation, your recent work experience must be in your nominated occupation. Other work experience in an occupation listed on the SOL will not be considered.<br />
<br />
The SOL lists all of the eligible skilled occupations for the purposes of General Skilled Migration and the number of points awarded for each. The SOL is available on the department's website at &lt;http://www.immi.gov.au/skilled/sol/&gt;<br />

THE PERIOD OF WORK EXPERIENCE REQUIRED:<br />
<br />
Applicants who are unable to demonstrate that they have, in the six (6) months immediately before applying for a General Skilled Migration visa, completed an Australian qualification at an Australian educational institution as a result of the equivalent of 92 weeks of CRICOS registered study in no less than 16 months, will need to demonstrate that they have been employed in a skilled occupation for at least 12 months in the last 24 months prior to lodging their application.<br />

POINTS FOR SPECIFIC WORK EXPERIENCE:<br />
<br />
Under the specific work experience part of the General Skilled Migration points test, you will be awarded points based on your nominated occupation and the period of specific work experience you have completed.<br />

The specific work experience part of the points test is different to the recent work experience requirement which is a basic requirement for all General Skilled Migration visa categories.<br />
<br />
Where your nominated occupation is worth 60 points and you have been employed in your nominated occupation, or a closely related occupation listed on the SOL, for at least three of the four years before the day of your application you may be awarded ten (10) points.<br />
<br />
Where your nominated occupation is worth 40, 50 or 60 points and you have been employed in any occupation listed on the SOL, for at least three of the four years immediately before the day of your application you may be awarded five (5) points.<br />

Applicants wishing to claim award of these points must have completed their professional year in their nominated skilled occupation or a closely related skilled occupation, for a period totalling, at least 12 months in the 48 months immediately before lodging their General Skilled Migration application.<br />
<br />
CLAIMING POINTS FOR PARTNER'S SKILLS:<br />
<br />
You may receive extra points on the General Skilled Migration points test if your partner is also able to satisfy the basic General Skilled Migration requirements of:<br />
*age<br />
*English language ability<br />
*nominated occupation on the SOL<br />
*recent work experience or eligible for a waiver of this requirement by obtaining an Australian degree, diploma or relevant trade certificate as a result of the equivalent of two (2) full-time academic years of study in Australia *having a suitable positive skills assessment from the relevant assessing authority for their nominated occupation.<br />
<br />
You cannot claim points for partner skills if your partner is an Australian citizen or Australian permanent resident.<br />
<br />
You should be aware that if you apply for a General Skilled Migration visa that can be granted whilst you are in Australia (an 'onshore' General Skilled Migration visa) and you are claiming an exemption from the recent work experience requirement on the basis of being a recent Australian graduate, you will only be able to include your partner in your visa application in limited circumstances. They must be in Australia at the time you apply and also be the holder of an eligible visa.<br />

EVIDENCE OF WORK EXPERIENCE:<br />
<br />
To demonstrate that you have been employed in a skilled occupation for the required period you will need to attach to your application certified copies of your work references for any positions held during the relevant period.<br />
<br />
Your work experience references must:<br />
*be written on the official letterhead of the company or government department providing the reference *the letterhead should indicate clearly the full address of the company and any telephone, fax numbers, email and website addresses *the name and position of the person authorised to sign the employment reference should be typed or stamped below that person's signature *the direct contact number of the person writing the reference should be included in the letter *the letter should indicate the exact period of employment, including whether permanent or temporary, full or part-time, position(s) held, the main five (5) duties undertaken, and the salary earned - positions should not be described by generic titles (e.g. research officer, public servant) but according to the nature of the duties undertaken (e.g. research chemist, accounts clerk) *a payslip from your current employment should also be included - this is especially important for applicants working in government departments.<br />
<br />
For some applicants (such as self-employed or contract workers), other documents which may assist you in evidencing your work experience claims could include, but are not limited to:<br />
*contracts<br />
*pay slips<br />
*tax returns<br />
*group certificates.<br />
<br />
WORK EXPERIENCE IN AUSTRALIA WHILST HOLDING A BRIDGING VISA:<br />
<br />
If you are using work experience obtained in Australia to meet a General Skilled Migration work experience requirement, that work must have been undertaken while you were the holder of a visa authorising you to work. This means that you may count periods of work undertaken whilst holding a Bridging Visa A or B as long as your Bridging Visa authorised you to work.<br />
<br />
SKILLED WORK EXPERIENCE IN AN OCCUPATION OTHER THAN THE NOMINATED OCCUPATION:<br />
<br />
If you are nominating a specified trade occupation, your recent work experience must be in your nominated occupation. Other work experience in an occupation listed on the Skilled Occupation List (SOL) will not be considered. In all other circumstances your recent work experience can be in any occupation listed on the relevant schedule of the SOL.<br />
<br />
You can also claim points for specific employment experience. 依然有朋友怀疑475可以挪窝,我今天又写信了,着重让解释一下下面2010.12.17日发表的这段话以及conditions 8539 or 8549的意思,收到回信的话我会在这个帖子里面和大家分享。
Changes for applicants for subclass 475 and 487 – 17 December 2010
Applicants for subclass 475 and 487 visas who applied between 1 July 2010 and 1 January 2011, and whose visa was granted in this same period, are not subject to conditions 8539 or 8549 which require the applicant to live and work in specified regional areas. This affects the ability of applicants granted visas in these circumstances to subsequently apply for a Subclass 887 visa.

Changes will take effect on 1 January 2011 which enable applicants in this position to apply for the Subclass 887 visa, provided they meet the requirements of living and working in a specified regional area.

告知你的担保地区你要走,为的是你的担保地区将来不找你的事。

475不行,我是看了那个政策,觉得不行。

176行,是因为我问移民局的时候,移民局告诉我这不关他们的事情,又不是他们担保的。

如果有什么理解不对的地方,请告知。提醒下后来人

朋友,这种问题一定要有证据,否则会影响大批论坛朋友今后的发展。因为我是475,所以比较关注475,移民局回信里面这段话

根据LS的签名,貌似 LS 还没有申请 475&nbsp;&nbsp;吧,至今仍没有visa grant 吧?。。也就是说,8539 or 8549&nbsp;&nbsp;将适用于 你哦

8539 or 8549&nbsp;&nbsp;是适用于我,意思应该就是requires you to live and work or study in a Specified Regional area 。移民局回信还有一段话A Specified Regional area is a:
*designated area if you were sponsored by a relative or *regional or low growth metropolitan area if you were sponsored by a state/territory.亲属担保的是designated area ,州担保的是a.....,紧接着就是这段并没有指明只适用于2010.7.1-2011.1.1的话,While the Skilled - Regional Sponsored visa does not prevent you moving to another regional area to live and work, generally, you would be expected to work and reside in a regional or low population growth metropolitan area within your sponsoring state or territory. You are encouraged to notify both the government agency that sponsored you originally, and the new state and territory government of your plans prior to your move.

我认为最好遵守承诺。挪窝只会让规则越来越严,后人更难申请。什么事情导致你申请了那个地区的担保,却又不履行你的承诺呢?如果是担心找不到工作,干脆放弃好了,不然到哪里都一样

您的想法我不敢苟同。
在我的帖子里面,我从来没有鼓动大家去挪窝,相反,我和很多475的朋友一样都是首选在担保地区生活和工作。我之所以写信给移民局、发这个帖子,是因为我们有权利也有必要搞明白挪窝的问题,多一条路多一个选择总是好的,您说是不是?我也希望我们论坛里、QQ群里所有475的朋友都能清楚的明白自己的权利和义务。
移民的路很艰辛也很难预料,也许我们在担保地区工作了一段时间后又在其他的地区找到了更诱人的工作,那请问您,如果您有了这样的机会您会不会去争取呢?
至于您说的规则更严、更难申请,就更和我们八竿子打不着了,就算我们论坛里的所有的475朋友都挪窝,能对移民政策产生影响?您太高估我们的影响力了。
再次声明一下,我发这个帖子的目的是希望给大家提供有用的信息。有移民局的回信我就会贴在这里,怎么去理解,那是个人的事了。

同意楼主意见。我们的首选地区都是担保地区,但我们拥有的权益是一定要搞清楚的啊!并且相信大多数人,不管是475还是176,都不会闲得没事就挪个窝玩儿玩儿,那不是给自己找麻烦么?

关于居住要求,我的理解是只要3年内在偏远地区居住满2年就可以,剩下的时间你也可以到市区去住。大家说我的理解对不?

475签证有效期3年,在这个有效期里面,我们可以任意选择居住或者工作的地方。
但是如果想申请887签证,则必须满足申请887的要求,
即:
持有包括475的签证,
指定地区居住满2年,
指定地区工作满1年。

所以,挪窝不影响475签证的有效性,但意味着放弃后续的887永居签证。

俺记得475是可以在找不到工作时与担保地区协商搬家。这个在orana的网页里面有提到,而且是一种要签字确认的条款。

我认识一个朋友,她就是475担保,但是挪窝了,前提是她首先选择了一个州,然后申请这个州同意接受她,她又给原先给她担保的州写信申请离开这个州,两个州都同意后,她挪窝了,当然不影响申请887了。真人真事,希望给想挪窝的同学一个信息。

475是可以挪窝的。但是,如果日后想申请887,则必须挪窝前和挪窝后都在指定地区。此外,决定挪窝时,也要知照一下原先担保你的州和接下来要去居住的州。

leciel95说得对,申请475 Orana担保的时候,的确要声明并签署一份commitment letter。这封letter就是要声明一下:如果找不到工作了,在经过和Orana RDA consultation之后,有意愿relocate到其它的region去。

顺便说一下,这封commitment letter是申请475 Orana担保必须要有的一份材料。因此,可以推断的是,只要挪窝之后还是在指定地区而非大城市,申请887是符合条件的。退一万步说,当前的移民条例中也没有说申请887之前的两年必须住在担保州,不是么?

担保时也有具体的区域的,因为一个州的偏远地区不止一个。比如说担保时你的声明是说在西澳的中部,但是实际上你跑到了西北部,但是中部和西北都是偏远地区,这种情况有人碰到没有?发生这种情况,如何处理?

除了NSW,其他州的475都是州政府担保的,不存在你承诺去这个州中部还是西部的问题,这个州任何475地区随便你去。

There may be some occupations, however, where full-time employment is less than 35 hours a week therefore you may be able to undertake two (2) part time positions in closely related occupations that equate to 35 hours per week. Please also note that any employment that is less than 30 hours a week will not be regarded as full-time.

是不是如果你的全职工作不满35小时一周的话你的兼职工作必须要和全职工作高度相关?
也就是说IT全职的话兼职做IT无关的就不能算小时数了?

持有相同签证的朋友说,475的签证必须居住在偏远地区。而我的理解是只要在3年内加起来在偏远地区住满2年,那就是说开始时你也可以住在市区,等到在偏远地区找到工作,然后再搬过去。这个时间段当然是不能影响你满足在偏远地区的居住2年这个时间要求。比如说居住了3个月就搬到了偏远地区了。在申请永居时,应该没有问题吧?

While the holder is in Australia, the holder must live, study and work only in a designated area in the State or Territory in which the holder's sponsor lived when the holder was first granted a Skilled - Designated Area-sponsored (Provisional) (Class UZ) visa.

Condition: 8539

While the holder is in Australia, the holder must not live, study or work outside a part of Australia the postcode of which was specified in the Gazette Notice for item 6A1001 of Schedule 6A, as the notice was in force when the condition was imposed.

SKILLED - REGIONAL SPONSORED VISA CONDITIONS:

If you are granted a Skilled - Regional Sponsored visa and have been nominated by a state or territory government, you and any secondary applicants will have condition 8539 placed on your visa. This condition requires you to live and work or study in a regional or a low population growth metropolitan area while in Australia. Short absences for holidays or business will however be permitted.
移民局给我的回信如上,既然说短期的不在偏远地区是允许的,我理解应该是可以的。

我现在是457,合同还有一年才结束。不过我申请了475,根据475,我必须搬到边远地区去工作。那么,我可不可以拿到475后,先不去边远地区,然后当前工作结束后,我再搬到边远地区?

今天查了VIC 176的政策, 很明显是要求登陆时开始的2年时间不挪窝哟!
Your sponsorship obligations
Notification of visa grant and arrival
You must email us with notification of DIAC’s decision on your visa application. You must also notify us by email when you arrive in Victoria.

If you are living outside Australia, you do not need to arrive in Australia before a certain date for the purpose of Victorian sponsorship, however DIAC usually stipulate a date by which you must enter Australia on your visa. Contact DIAC directly with any queries regarding this requirement.

Live and work in Victoria for two years
You, and any sponsored dependants, must live in Victoria for the first two years of your sponsored visa. This two year period begins when you enter Australia permanently on your Skilled – Sponsored (176) visa.
Complete five email surveys
There are five short surveys that you must complete over the two year period. The surveys will be sent to you via email.

You will receive your first survey when you arrive in Australia and then you will receive one every six months.

The responses and feedback in the surveys are used to evaluate and improve the Victorian Government’s Skilled and Business Migration Program.

Employment
While we hope you are able to find work in your nominated occupation, it is not mandatory to work in your nominated occupation.
