移民法里面对移民打分的说明:申请移民首先要建立评分。移民局内部签证官指导条例PAM里面谈到,申请人只要在递交了申请后,移民局完成决定前,满足评分,仍然合格。
把相关移民条例发给签证官,确保其理解这个条例(很多签证官在某些政策上也是菜鸟,人无完人嘛!所以我们移民代理就要与其沟通)。其次,万一遇到一个不讲理的签证官,给拒签了,这也不是世界末日,根据澳大利亚移民法,移民代理会去MRT移民仲裁法庭上诉,MRT会重新审核,驳回移民局决定。
为了给大家了解相关法律,我特此copy了法律条例以飨读者:
10 Establishing the assessed score
10.1 What is an assessed score
The assessed score is the total score an applicant receives when assessed against each factor of the points test in Schedule 6B. An assessment for the purposes of s93 of the Act may be made any time between the making of the visa application and the decision to grant or refuse the visa.
10.2 Initial estimate
In some cases, to decide what further action, if any, that is needed in a case, officers may need to estimate the applicant's assessed score. This estimate does not constitute the applicant's actual assessed score and applicants should not be given any estimated score, as to do so may, in law, inadvertently make that estimate the actual assessed score. An assessed score should be given only when a final score for each relevant Schedule 6B factor can be given.
10.3 The effect of giving an assessed score
An assessed score, once given, does not change. Officers cannot “revisit” or “revoke” an assessed score, regardless of whether doing so favours (or disadvantages) the applicant.
However, if a decision to refuse a visa is subsequently the subject of a merits review application, the review authority can, among other things, set the decision aside and substitute a new decision (see s338(8) and s349 of the Act). This may include giving the applicant a fresh assessed score under Schedule 6B. This does not constitute “revisiting” the primary decision.
另外移民局特别提到了从2010年1月1日起,885签证第213条规定,申请人只要满足能力英文(雅思4个6)就可以有权利递交移民885签证。
他们还专门注了一下高等法院对Berenguel案例的判决,作为先例。该案件非常著名,申请人递交签证的时候雅思不合格,后来合格了,法院判申请人胜诉。
For applications made on or after 1 January 2010, clause 885.213 requires that at the time of visa application the applicant have competent English, see regulation 1.15c.
Note: Because of the High Court decision in Berenguel, applicants for this visa subclass have until the time of visa decision to provide evidence of their English language ability.
