Contact Us->Visa Enquiries->Workers->]

我的问题:
I am writing to concern the "points for partner skills ", both of my partner and I are not Australian citizen nor Australian permanent resident.

We get below information from website about the requirements for claiming extra partner skills points on GSM points test, regardless of the age, English ability and others,is there any limitation that we should be on the "SAME" Skilled Occupation List (SOL)?
I mean if my partner and I are on different SOL lists (as we know, there two SOL lists: SOL Schedule 1 and SOL Schedule 2),
for example, suppose I am the primary applicant, and:
1. My occupation is on the SOL-2, my partner's occupation is on the SOL-1, or
2. My occupation is on the SOL-1, my partner's occupation is on the SOL-2
Is there any difference between these 2 situation? Are we still qualified on matching the SOL requirement for claiming "points for partner skills"?

移民局的回复:其实我觉得回了跟没回的效果一样,都是官方的回答
Dear Client,

Thank you for your correspondence.

*** IMPORTANT INFORMATION ***

For information on how current processing priorities will affect your application see the department's website at http://www.immi.gov.au/skilled/g ... ation/whats-new.htm

Information about the 1 July 2011 points test is available at http://www.immi.gov.au/skilled/g ... pdf/points-test.pdf

Information about all requirements relating to a particular General Skilled Migration visa including information for applicants eligible for transitional arrangements is available on the department's website at http://www.immi.gov.au/skilled/g ... on/visa-options.htm

***************************************************************************************************
NOMINATING A SKILLED OCCUPATION

To apply for General Skilled Migration you must nominate an occupation that is on the Skilled Occupation List (SOL) at the time you apply. The SOL lists all of the eligible skilled occupations for General Skilled Migration purposes and the number of points awarded to each. If your occupation is not on the SOL and you do not have the skills or qualifications to nominate another occupation that is on the SOL then you will not be eligible for General Skilled Migration. More information on the SOL is available on the department's website at http://www.immi.gov.au/skilled/g ... led-occupations.htm

SKILLS ASSESSMENT FOR THE NOMINATED OCCUPATION - OFFSHORE GENERAL SKILLED MIGRATION VISAS

In order to make a valid application for one of the General Skilled Migration 'offshore' visas you must also attach a suitable skills assessment from the relevant Australian assessing authority for your nominated skilled occupation with your application. 'Offshore' visas include:
* Skilled - Independent (subclass 175)
* Skilled - Sponsored (subclass 176)
* Skilled - Regional Sponsored (subclass 475).

To be granted a visa in one of the categories listed above, your skills must have been assessed as suitable for your nominated skilled occupation. This requirement applies to all applicants - even those who have studied or worked in Australia prior to lodging a General Skilled Migration visa application.

Please note that applicants for the Skilled - Recognised Graduate (Subclass 476) visa are not required to undergo a skills assessment as part of their General Skilled Migration application.

SKILLS ASSESSMENT FOR THE NOMINATED OCCUPATION - ONSHORE GENERAL SKILLED MIGRATION VISAS

In order to make a valid application for one of the General Skilled Migration 'onshore' visas you must also attach a suitable skills assessment from the relevant Australian assessing authority for your nominated skilled occupation with your application. 'Onshore' visas include:
* Skilled - Independent (subclass 885) visa
* Skilled - Sponsored (subclass 886) visa
* Skilled - Regional Sponsored (subclass 487)
* Skilled - Graduate (subclass 485).

If however, you are applying for a Skilled - Graduate (subclass 485) visa, you do not need to attach a suitable skills assessment when you lodge your application but you must provide evidence you have applied for a skills assessment at time of application. When available, a suitable skills assessment from the relevant Australian assessing authority must be submitted to General Skilled Migration Brisbane (GSMB) to facilitate a decision on your General Skilled Migration application.

If you are a Skilled - Independent Regional (subclass 495), a Skilled - Designated area Sponsored (subclass 496) or Skilled - Regional Sponsored (subclasses 487 or 475) visa holder and have complied with your visa conditions, you are not required to submit a skills assessment when applying for Skilled - Regional (subclass 887) visa.

OBTAINING A SKILLS ASSESSMENT

The Skilled Occupation List (SOL) lists the relevant Australian assessing authority for each occupation on the SOL. The SOL and contact details for these assessing authorities is available on the department's website at http://www.immi.gov.au/skilled/sol/
It is your responsibility to contact the relevant Australian assessing authority for your nominated occupation to arrange an assessment of your skills. Each assessing authority has its own assessment procedures, timeframes and charges. You are strongly advised to contact the relevant Australian assessing authority about your skills assessment well before you intend to lodge your application.

Assessing authorities are responsible for undertaking skills assessments for migration purposes and are not employment agencies and therefore will not reply to requests for job placement. In addition, they cannot give advice on the allocation of points or the likely success of your General Skilled Migration application.

In almost all cases, assessing bodies will require that you have post-secondary, such as university or trade qualifications in order to receive a positive assessment of your skills.

In a small number of occupations, substantial relevant work experience may be acceptable instead of formal qualifications. Each assessing authority will be able to advise you on the requirements for the occupation/s they assess.

Some assessing authorities may impose a validity date on a skills assessment. If your assessment is only valid for a certain period, you will need to ensure that your application is lodged within this timeframe.

SKILLS ASSESSMENTS FOR MEDICAL PRACTITIONERS

If your nominated occupation is 'Medical Practitioner', you should read the information on skills assessments for Medical Practitioners on the department's website at http://www.immi.gov.au/skilled/medical-practitioners/doctors.htm

EVIDENCE TO ATTACH TO YOUR APPLICATION

If you are applying for a Skilled - Independent (subclass 175), Skilled - Sponsored (subclass 176), Skilled - Regional Sponsored (subclass 475) visa, Skilled - Regional Sponsored (subclass 487), Skilled - Independent (subclass 885), or a Skilled - Sponsored (subclass 886) you must attach a certified copy of your suitable skills assessment from the relevant Australian assessing authority for your nominated occupation with your application.

You should, however, keep the original skills assessment as the department may request this during processing of your application.

You should also attach a certified copy of your post-secondary qualifications, such as your degree, diploma or trade qualification plus your transcripts or mark sheets with your application.

If you have worked in an occupation where substantial work experience may be acceptable instead of post-secondary qualifications, you must provide certified copies of references provided by your employers that outline the position you held, and the duties you have performed in that role.

If however, you are applying for a Skilled - Graduate (subclass 485) visa, you do not need to attach a suitable skills assessment when you lodge your application but you must provide evidence you have applied for a skills assessment at time of application. However, to facilitate us processing your application more quickly, it is strongly advised that applicants attach evidence of their suitable skills assessment when lodging their application.

*********************************************************************************
Skilled - Regional Sponsored (Provisional) Visa (Subclass 475)
Partner Skills - Points
You can claim 'partner skills' points if your partner is also able to satisfy the basic requirements of age, English language ability, has nominated an occupation on the same Skilled Occupation List (SOL) as the primary applicant for which they have obtained a suitable skills assessment from the relevant assessing authority and they meet the Australian study requirement or have recent work experience in a skilled occupation which is on the SOL as the primary applicant.

Important: You cannot claim 'partner skills' points if your partner is an Australian permanent resident or an Australian citizen or if they are not included in your visa application.
Points awarded
The table below sets out the points available under this part of the points test.
Points        Description of partner skills

See: http://www.immi.gov.au/skilled/g ... ibility-english.htm
*evidence that they meet the skilled employment or Australian study requirement.
See: http://www.immi.gov.au/skilled/g ... ific-experience.htm
For you to be awarded these points, documentary evidence as described above must be provided before the points assessment.

Yours sincerely,

Erin

移民局的回复说的是You must obtain documentary evidence that your partner has met all the basic requirements for the particular General Skilled Migration visa that you are applying for.
我的理解是说如果申请175,那么两个人的职业都要在sol1上才能加分
申请176的话,因为176的职业包括了sol1和sol2,那么就都可以加分了
