小白问题:没有公司抬头纸的work reference/工作年限

官方的确没有明确要求你给出为何不能找原雇主，而只能找以前同事给employment reference的理由。但从申请材料的一致性，以及前后呼应的角度来看，你让以前同事写上这点，会让ACS，还有日后的签证官更好理解，以及增加你材料的可信度。

有时间的话可以找些介绍如何写个人简历，学校申请信之类的材料看看，会让你的材料增色不少。

是不是我们对Statutory Declaration的理解不一致？

看看澳洲法律部对其解释：

A statutory declaration is a written statement that allows a person to declare something to be true.

When you make a statutory declaration, you are declaring that the statements in it are true. If you intentionally make a false statement in a declaration, you can be charged with an offence. The penalty for making a false statement in a statutory declaration is a maximum of four years imprisonment.

你找以前同事开书面证明，就是这种Statutory Declaration 啊。因为是个人声明，所以不能用有公司抬头的信纸。

不是吧？statutory declaration是work reference之外的一份声明。

你的同事就是要出一份statutory declaration，证明你的工作经历（allows a person to declare something to be true）啊。你的工作经历，就是这里说的something to be true啊。

难道你要同事先出一份work reference，然后再找大使馆开一份statutory declaration，证明你同事的work reference是真的？

2.澳大利亚驻上海大使馆有这个服务需要证明人去当场写然后大使馆作为Signature of person before
whom the declaration is made的一方给签字。

请问楼主后来是怎么写的？
目前我们也遇到这个问题了，十分头疼。
acs没有承认我们前面几年的工作经验（公司都倒闭了），需要我们做这个statutory declaration。另外ACS从今年1月底更新了细则，更加仔细，要求更多。
关于这个third party 我也很迷糊，比如这里guidelines第13页的----a
third party official Statutory Declaration or Affidavit written by a work colleague may be considered.
然后在Important note 里面又说------Statutory Declarations or Affidavits must be written by a third party work colleague and signed by an
authorised witness to be considered suitable.

就我的理解，法定声明就是你的前同事（最好是你的上级）证明你在前公司工作过，并说明你的工作时间，职责和范围。法定证明需要有一个有资格的第三方来做见证人，证明你的前同事亲自做了这份法定声明，不是别人伪造的。符合规定的法定声明是有法律效力的，做假的法定声明是犯罪，就像证人在法庭里手按圣经宣誓一切所说的都是真实的，法官就是有资格的第三方见证人。我有两份经历都是做的法定声明，按ACS提供的模板格式写的，第三方见证人是找了在银行做的朋友签字，复印了他的工作证和银行从业资格证书。刚提交上去，还不能确定是否有效。如果有条件去大使馆，还是拉上你的前同事去大使馆做吧，绝对有效。

我们这边实在是太不方便去大使馆了。在考虑也许找个律师做见证。
你说的模板格式是澳洲的statutory declaration格式吧？
